Terms & Conditions

1. Introduction and Scope
These Terms & Conditions ("Terms") govern the use of the Sanity Home Based Tuition Academy ("SHTA," "we," "us," or "the Academy") teacher and student portal, including all enrollment, tutoring, assignment, and communication services offered through it.
These Terms apply to:
- Parents/Guardians who enroll a student and manage their account
- Students who use the portal to access lessons, assignments, and progress records
- Tutors/Teachers who use the portal to manage classes, assignments, and student records
By submitting an enrollment form, creating an account, or logging into the portal, you confirm that you have read, understood, and agree to be bound by these Terms.
2. Description of Service
SHTA provides home-based tutoring services, including but not limited to:
- One-on-one and group tutoring in ICT, Computer Science, Business Studies, and other subjects
- Timed assignments and Continuous Assessment Tests (CATs)
- Exam preparation support, including for internationally recognized curricula (e.g., Cambridge IGCSE)
- Progress tracking, grading, and reporting through the teacher/student portal
3. Account Responsibilities
- All information provided during enrollment or account setup must be accurate and kept up to date.
- Each account is intended for use by a single individual. Login credentials must not be shared with anyone else.
- Parents/guardians are responsible for the accuracy of information submitted on behalf of a minor student, and for supervising the student's use of the portal where appropriate.
- Users must notify SHTA promptly if they suspect unauthorized access to their account.
4. Acceptable Use
Users agree not to:
- Share login credentials with any other person
- Attempt to access another student's or user's data, assignments, or grades without authorization
- Misuse timed assignments or CATs, including any attempt to gain unfair advantage during assessments
- Use the portal for any purpose unrelated to tutoring, learning, or academy administration
- Attempt to disrupt, reverse-engineer, or interfere with the operation of the portal
Violation of this section may result in suspension or termination of an account.
5. Payments
- Tuition and related fees are payable as agreed between the parent/guardian and SHTA, primarily via M-PESA or other agreed payment methods.
- Payment references and invoices are recorded within the portal for the purposes of billing and record-keeping.
- Refund and cancellation terms for tuition fees will be communicated separately or upon enrollment, and are subject to the Academy's standard tutoring agreement.
6. Intellectual Property
- All exam papers, study materials, lesson content, and other resources created or provided by SHTA or its tutors remain the intellectual property of SHTA (or its licensors, where applicable).
- Users may use these materials for personal study purposes only. Redistribution, resale, or public sharing of SHTA's materials without written permission is prohibited.
7. Termination
SHTA reserves the right to suspend or terminate a user's access to the portal in cases including, but not limited to:
- Non-payment of agreed tuition fees
- Violation of the Acceptable Use section above
- Providing false or misleading information during enrollment or account setup
Users (or a parent/guardian, on behalf of a student) may also request termination of an account by contacting SHTA directly.
8. Limitation of Liability
- SHTA provides tutoring and academic support services in good faith but does not guarantee specific exam outcomes, grades, or academic results.
- SHTA is not liable for temporary unavailability of the portal due to technical issues, maintenance, or circumstances beyond its reasonable control.
- To the fullest extent permitted by law, SHTA's liability for any claim arising from use of the portal is limited to the fees paid for the relevant tutoring service.
9. Changes to These Terms
SHTA may update these Terms from time to time. When changes are made:
- The effective version will be identified by a version number and date at the top of this document.
- Existing users will be notified of updated Terms via the Privacy tab within their portal and asked to review and accept the updated version.
- Continued use of the portal after being notified of updated Terms constitutes acceptance of those changes.
10. Governing Law
These Terms are governed by the laws of the Republic of Kenya. Any disputes arising from these Terms or use of the portal shall be subject to the jurisdiction of the courts of Kenya.
